Topics: The Conference will deal with the mechanisms of settlement of public and private disputes in the area of international trade in the region of the Caucasus and Central Asia. Efficient and reliable dispute settlement mechanisms are substantial for international trade, which is an important vehicle of every modern economy. During the last decades, the countries of the region under consideration have adopted a lot of national rules (e.g. laws on international commercial arbitration) and joined a number of treaties (i.e. some of the countries are the members of the WTO; there are specific treaties within the framework of the Commonwealth of Independent States and Eurasian Economic Community; a new Treaty on Eurasian Economic Union has been signed recently) which are related to dispute settlement in trade matters. This Conference will focus on settlement of trade disputes under public international law and private trade disputes with an international link.
The goal is not just to present both public international and private dimensions of the legal framework for settlement of trade disputes, but also to compare specific aspects (e.g. transparency of proceedings) of different dispute settlement mechanisms. Special session will be dedicated to settlement of international energy disputes, the latter being the most important branch of economy for many countries in the region. Another special topic of the Conference will be participation of states and state affiliated companies from the countries of the region in international trade disputes. The number of international trade disputes is rising rapidly: on the one hand, countries are joining numerous Treaties, which provide for international dispute settlement instruments (e.g. the WTO, the Eurasian Economic Community), on the other hand, state owned companies are more and more active as traders. Often public authorities do not have any strategies and algorithms, nor qualified specialists for dispute settlement issues. Considering this, we will organize during the Conference a round table with participation of high-level officials, academics and practitioners to discuss the challenges of participation in international trade disputes for the States of the region.
Speakers: The Conference will offer an opportunity for discussions with high-level representatives from the countries of the region, EU Member States and institutions, international organizations as well as academics and practitioners with extensive experience in the field of international dispute settlement.
